Naturalization Through Form N-400

N-400 is the form used to apply for U.S. citizenship through naturalization. This process is typically available to lawful permanent residents (green card holders) who meet the eligibility requirements.

Eligibility Requirements for Naturalization:

  • You must be at least 18 years old
  • Be a lawful permanent resident (green card holder) for at least:
  • 5 years (general rule)
  • OR 3 years if you obtained your green card through marriage to a U.S. citizen and are still married and living together
  • Maintain continuous residence in the U.S.
  • Demonstrate physical presence in the U.S.
  • Show good moral character
  • Pass a civics and English test (with certain exceptions)
  • Take the Oath of Allegiance

Derivative Citizenship Through Form N-600

Some individuals do not need to naturalize — they are already U.S. citizens by law through their parents. This is called derivative citizenship, and it’s claimed through Form N-600.

 

You may qualify if:

  • You were born outside the U.S. to a U.S. citizen parent
  • You were under 18 when your parent became a U.S. citizen
  • You are a green card holder living in the U.S. in legal custody of the citizen parent

The laws around derivative citizenship are complex and time-sensitive, as eligibility depends on the law in effect at the time of birth and parental status.

 N-400 is used to apply for naturalization (you become a citizen). N-600 is used to claim citizenship you already have through your parents.

Processing times vary, but on average, it takes 8–12 months. It depends on your local USCIS field office.
